1. About Auttiv and this policy
This DMCA & Copyright Policy ("Policy") is provided by Auttiv Group LLC, a Texas limited liability company doing business as "Auttiv" ("Auttiv," "we," "us," or "our"), located at 12922 Staton Drive, Austin, TX 78727.
Auttiv operates an online marketplace and vehicle-listings platform. We are not a car dealer, broker, auction house, or party to any vehicle sale. Auttiv simply connects shoppers and sellers and displays automotive listings. Auttiv does not take possession of, finance, or handle the money for any vehicle purchase.
Auttiv respects the intellectual property rights of others and expects users of the platform to do the same. This Policy explains how we respond to claims of copyright infringement under the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.
2. Aggregated dealer inventory
A significant portion of the vehicle listings on Auttiv is aggregated automatically from publicly available dealer websites and public inventory sources. This may include vehicle photographs, descriptions, specifications, pricing, and similar information that originates from a dealer's own public-facing website or feed.
Auttiv displays this material to help consumers discover vehicles. We do not claim ownership of dealer-provided photographs or descriptions. If you are a dealer (or rights holder) and you do not want your inventory, photos, or text displayed on Auttiv, you may opt out at any time — see Section 3 below. If your concern is specifically a copyright claim, follow the formal notice-and-takedown procedure in Section 4.
3. Dealer opt-out (removing your inventory or photos)
Dealers do not need to submit a formal legal notice simply to have their inventory removed. To opt out of aggregation, email dmca@auttiv.com from a business email address associated with the dealership and include:
- Your dealership's legal name and physical address
- The website domain(s) or inventory source(s) the listings come from
- Whether you want all of your inventory removed, or only specific vehicles, photos, or text (with links or identifiers such as VINs)
- Your name, title, and a phone number where we can reach you to confirm the request
We will process valid opt-out requests promptly and will stop displaying the requested material. We may take reasonable steps to verify that the request comes from an authorized representative of the dealership.
4. Notice-and-takedown: reporting copyright infringement (17 U.S.C. § 512(c))
If you believe that material on Auttiv infringes a copyright you own or control, you may submit a written notification of claimed infringement (a "DMCA Notice") to our Designated Agent at dmca@auttiv.com.
To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include substantially all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list of such works).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — for example, the URL(s) on auttiv.com, the vehicle VIN(s), or other specific identifiers.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA Notice, we will act expeditiously to remove or disable access to the material identified in the notice. We may, at our discretion, notify the party that supplied the material that it has been removed or disabled.
5. Counter-notification
If you believe that material you submitted was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Agent at dmca@auttiv.com. To be effective under 17 U.S.C. § 512(g)(3), a counter-notification must include substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the judicial district in which Auttiv may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.
If we receive a valid counter-notification, we may forward it to the original complaining party. If that party does not notify us within 10 business days that it has filed an action seeking a court order to restrain the allegedly infringing activity, we may, at our discretion, restore the removed material in 10 to 14 business days following receipt of the counter-notification.
6. Repeat-infringer policy
In accordance with the DMCA and other applicable law, Auttiv has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or access of users who are determined to be repeat infringers. We may also limit access to the platform or remove content for any user who infringes the intellectual property rights of others, whether or not there is repeat infringement.

9. Governing law and disputes
This Policy is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Policy will be resolved by binding arbitration seated in Travis County, Texas, as further described in our Terms of Service. Nothing in this Policy limits any party's rights and remedies under the DMCA.
10. Changes to this Policy
We may update this Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will take effect when posted on this page.
